Axel® internal regulations applicable to trainees during training
for Axel Conseil®, Axel Sport®, Axel Golf®, Axel Foot® and Axel English® training courses

A. Preamble
The Axel Company develops professional training activities.
These Internal Regulations are intended to specify certain provisions applying to all registrants and participants in the various training courses organized by Axel in order to enable optimal functioning of the training courses offered.
 
B. General provisions


Article 1
In accordance with articles L.6352-3, L.6352-4 and R.6352-1 to R.6352-15 of the Code du Travail, the purpose of these Internal Regulations is to define the general and permanent rules and to specify the regulations in matters of health and safety as well as the rules relating to discipline, in particular the sanctions applicable to trainees and their rights in the event of sanction.
 
C. Scope of application of the regulations


Article 2: Persons concerned
These Regulations apply to all trainees registered for a session provided by Axel for the entire duration of the training. Each trainee is considered to have accepted the terms of these regulations when she/he attends training provided by Axel and accepts that measures will be taken against him in the event of non-compliance with the regulations.

Article 3: Training locations
The training will take place either in Axel premises, in premises outside the Axel company, or in the premises of the client company. The provisions of these Regulations are applicable in any premises or space intended to receive Axel training.

Article 4: Catering
Trainees are offered either to eat in the premises of the client company or in a restaurant within the training location or in a nearby restaurant. In all cases, people make the trip under their own individual responsibility.

D. Hygiene and safety

Article 5: General rules
Each trainee must ensure their personal safety and that of others by respecting the general and specific safety and hygiene instructions in force at the training location. However, in accordance with article R.6352-1 of the Code du Travail, when training takes place in a company or establishment that already has internal regulations, the health and safety measures applicable to trainees are those of this internal regulation.

Article 6: Fire instructions
In accordance with articles R. 4227-28 et seq. of the Code du Travail, fire instructions and in particular a plan for the location of fire extinguishers and emergency exits are displayed in the training premises so as to be known to all trainees. Trainees are required to immediately execute the evacuation order given by the course leader or an employee of the establishment. The instructions in force in the establishment, to be observed in the event of danger and especially fire, must be scrupulously respected.

Article 7: Accident
Any accident or incident occurring during training or during training must be immediately reported by the injured trainee or people who witnessed the accident to the Axel manager. In accordance with article R. 6342-3 of the Code du Travail, an accident occurring to the trainee while he is at the training site or while he is going there or returning there, is subject to a declaration by Axel's manager to the competent social security fund.
When the training takes place on the client's premises or premises made available by the client, the trainee victim of the accident mentioned in the previous paragraph – or the witness to this accident – must immediately notify the management of the trainee's company , who then takes the appropriate steps in terms of care and makes the declaration to the competent social security fund.
 
Article 8 - Alcoholic beverages and drugs
The introduction or consumption of drugs or alcoholic beverages in the training premises is strictly prohibited. Trainees are prohibited from entering or remaining in a state of intoxication or under the influence of drugs in the training location.
 
Article 9 - Smoking
Pursuant to Decree No. 2006-1386 of November 15, 2006 setting the conditions for applying the ban on smoking in places designated for collective use, smoking is prohibited in training premises, except in areas reserved for this use.
 
E. Discipline


Article 10: Dress and behavior
Trainees are invited to appear at the training site in decent clothing and to behave correctly towards any person present at the training site.

Article 11: Times – Absence and delays
The training schedules are set by the manager of the Axel training organization and brought to the attention of the trainees either by invitation or when the training program is given to the trainees.
Axel reserves, within the limits imposed by the provisions in force, the right to modify the training schedules according to service requirements.
Trainees are required to respect schedules under penalty of the application of the following provisions:
  • In the event of absence or lateness for the course, trainees must notify the trainer or the Axel secretariat.
  • When the trainees are employees undergoing training as part of the training plan, the organization must inform the company in advance of these absences and delays. Any absence or delay not justified by special circumstances constitutes an offense punishable by disciplinary sanctions.
  • For trainees benefiting from financing by public authorities, unjustified absences will result, in application of article R 6341-45 of the Code du Travail, in a withholding of financing and/or remuneration proportional to the duration of said absences.
Furthermore, trainees are required to complete or sign an attendance sheet on a regular basis as the action progresses.

Article 12: Recordings, photos and videos
It is strictly forbidden, unless expressly authorized, to record, photograph or film training sessions.

Article 13: Educational documentation
The educational documentation provided during the training sessions is protected by copyright and may not be reused for any other use than for strictly personal. Any reproduction, representation, in whole or in part, by any means whatsoever, made outside the framework of this training, is prohibited without the express consent of the author, and constitutes an offense of counterfeiting punishable by articles L. 335- 2 et seq. of the Code de la Propriété Intellectuelle. No internet broadcasting is permitted.

Article 14: Participants' personal property
Axel declines all responsibility in the event of loss, theft or damage to personal objects of any kind left by trainees in the training premises.

Article 15 - Use of material
Unless specifically authorized by the management of the training organization, the use of training equipment takes place on the training sites and is exclusively reserved for the training activity. The use of the material for personal purposes is prohibited.
The trainee is required to keep the equipment entrusted to him for training in good condition. He must use it in accordance with its purpose and according to the rules issued by the trainer.
The trainee immediately reports any equipment anomalies to the trainer.
 
Article 16 – Sanctions and disciplinary procedures
Any failure by the participant to comply with one of the provisions of these Internal Regulations may be subject to a sanction or disciplinary procedure governed by articles R. 6352-3 to R. 6532-8 of the Code du travail reproduced as follows :
 
Article R. 6352-3
Any measure, other than verbal observations, taken by the director of the training organization or his representative, following an action by the trainee considered by him to be at fault, constitutes a sanction, whether this measure is likely to immediately affect or not the presence of the person concerned in the training or to call into question the continuity of the training he receives.
Fines or other monetary sanctions are prohibited.

Article R. 6352-4
No sanction may be imposed on the trainee without him having been informed in advance of the grievances against him.

Article R. 6352-5
When the director of the training organization or his representative plans to take a sanction which has an impact, immediate or not, on the presence of a trainee in training, the procedure is as follows:
- The director or his representative summons the trainee, indicating the purpose of this summons. This summons specifies the date, time and place of the interview. It is written and is sent by registered letter or delivered to the interested party against discharge;
- During the interview, the trainee can be assisted by the person of their choice. The summons mentioned mentions this possibility;
- The director or his representative indicates the reason for the envisaged sanction and collects the trainee's explanations.
 
Article R. 6352-6

The sanction cannot occur less than one full day nor more than fifteen days after the interview.
It is the subject of a written and reasoned decision, notified to the trainee by registered letter or delivered against receipt.

Article R. 6352-7
When the action has made a provisional measure of temporary exclusion with immediate effect essential, no definitive sanction relating to this action can be taken without the procedure provided for in Article R. 6352-4 and, possibly, in articles R. 6352-5 and R. 6352-6, has been observed.

Article R. 6352-8
The director of the training organization informs of the sanction taken:
- The employer, when the trainee is an employee benefiting from a training action as part of a company's training plan;
- The employer and the approved financing body which covered the training expenses, when the trainee is an employee benefiting from individual training leave;
- The approved financing body which ensured the financing of the training action from which the trainee benefited.

F. Representation of participants

Article 17 – Representation - Election and mandate
When a training has a total duration of more than 500 hours, a titular delegate and a substitute delegate are elected by two-round single-member ballot. All trainees are eligible to vote and are eligible, except inmates admitted to participate in professional training.
The training organization organizes the vote which takes place during training hours, no earlier than 8 p.m., no later than 40 hours after the start of the course. If it is impossible to designate the trainee representatives, the training organization draws up a report of deficiency which it transmits to the territorially competent regional prefect.
Delegates are elected for the duration of the training. Their functions end when they cease, for whatever reason, to participate in the training.
If the titular delegate and the alternate delegate have ceased their functions before the end of the training session, a new election is carried out under the conditions provided for in articles R.6352-9 to R.6352-12. The trainee representatives make any suggestions to improve the progress of the internships and the training conditions of the trainees in the training organization. They present all individual or collective complaints relating to these matters, health and safety conditions and the application of the internal regulations.

G. Advertising and date of effect

Article 18- Advertising
These regulations are reproduced on the website of the training organization.
They are also sent to the trainee or his employer as the case may be, at the same time as the quote, contract or agreement to be signed, made available to trainees during the training, on request from the trainees.

Article 19 - Date of effective entry into force
These regulations come into force on the date hereafter.
